CHICANE AUCTIONS – TERMS & CONDITIONS (UPDATED)
ChicaneAuctions.com.au is owned and operated by Chicane Classic Cars Pty Ltd (ACN 636 736 448), licensed to conduct motor vehicle auctions in Victoria (LMCT MCT-11962).
By registering, bidding, or otherwise participating in any auction conducted by Chicane Auctions (“Auctioneer”), you agree to be bound by these Terms & Conditions.
1. DEFINITIONS
— Auctioneer means Chicane Classic Cars Pty Ltd and its employees, agents, and representatives
— Auction Sale means any timed online auction conducted via the Auctioneer’s platform
— Bidder means any registered user approved to participate in an auction
— Buyer means the highest accepted bidder at the close of an auction (subject to reserve)
— Seller / Vendor means the owner of the Lot or person authorising its sale
— Lot means any vehicle or item offered for sale
— Purchase Price means the final accepted bid amount
— Buyer’s Premium means 8.8% (including GST) payable to the Auctioneer
— Extended Time means the rolling extension period applied to late bids
— Payment Processor means Stripe
— Trust Account means the Auctioneer’s regulated client trust account used to hold buyer funds
2. AUCTION STRUCTURE
a. The Auctioneer acts strictly as agent for the Seller
b. The contract of sale is between Buyer and Seller
c. All auctions are conducted as timed online auctions
d. The Auctioneer reserves the right to:
— accept or reject any bid
— withdraw any Lot
— cancel or relist any auction
3. REGISTRATION & BIDDER APPROVAL
a. All bidders must:
— be 18 years or older
— provide full identification details
— register a valid credit/debit card
b. Registration requires:
— full name
— residential address
— email and phone
— valid payment method (via Stripe)
c. The Auctioneer may:
— approve or reject any bidder
— suspend accounts at its discretion
d. By registering, bidders agree to:
— these Terms
— Stripe payment processing terms
4. BIDDING SYSTEM (AUCTIONMETHOD PLATFORM)
a. Bidding is conducted via:
— QuickBid (fixed $250 increments)
— AutoBid (proxy bidding system)
b. AutoBid:
— automatically increases bids in $250 increments
— up to the bidder’s nominated maximum
c. Minimum bid increment:
— $250 across all price ranges
d. Bids:
— are binding and cannot be withdrawn
— represent a legal offer to purchase
e. The Auctioneer’s system records are:
— final and binding in the event of dispute
5. AUCTION TIMING & EXTENSIONS
a. Auctions close at the stated time (AEST/AEDT)
b. If a bid is placed within the final moments:
— the auction enters Extended Time (2 minutes)
— resets with each new bid
c. The auction ends only when:
— no further bids are received within the extension window
6. RESERVE PRICE
a. Lots may be subject to a confidential reserve
b. A Lot is only sold when:
— reserve is met, or
— Auctioneer confirms sale
c. If reserve is not met:
— Auctioneer may negotiate post-auction with bidders
7. BUYER’S PREMIUM & STRIPE PROCESS
a. A Buyer’s Premium of 8.8% (inc GST) applies to all sales
b. Upon placing a bid:
— Stripe may place a pre-authorisation hold
c. Upon winning:
— Buyer’s Premium is automatically charged instantly
d. The Buyer authorises:
— immediate processing of this fee upon auction close
e. The Buyer’s Premium is:
— non-refundable in case of default
8. PAYMENT & SETTLEMENT
a. The Buyer must pay the remaining balance (Purchase Price) within:
5 business days of auction close
b. All payments must be made to:
Chicane Auctions Trust Account
c. The Seller is paid:
— only after funds clear
d. Title does not pass until:
— full cleared funds are received
e. Failure to complete payment:
— results in forfeiture of Buyer’s Premium
— may result in legal recovery action
f. The Auctioneer may:
— resell the vehicle
— recover any loss from the defaulting buyer
9. RISK, TITLE & INSURANCE
a. Risk passes to the Buyer at:
fall of the hammer (auction close)
b. Title transfers only after:
full cleared payment
c. Buyer must:
— arrange insurance immediately upon winning
10. VEHICLE CONDITION & DISCLAIMER
a. All vehicles are sold:
“as is, where is”
b. Vehicles are:
— collector items
— not guaranteed roadworthy
— sold unregistered unless stated
c. Information provided:
— may be based on Seller input
— may not be independently verified
d. Buyers must:
— conduct their own inspections
— rely on their own judgement
11. INSPECTIONS & SHOWROOM CONDITIONS
a. Inspections are:
— strictly by appointment only
b. Vehicles:
— are presented as static showroom display items
c. The following are strictly prohibited:
— test drives
— operation by bidders
— unsupervised access
d. Only authorised Chicane staff may:
— start, move, or reposition vehicles
12. ONLINE PLATFORM DISCLAIMER
a. The Auctioneer is not responsible for:
— internet delays
— system errors
— missed bids
b. Bidders accept all risks relating to:
— use of the online platform
13. DEFAULT & ENFORCEMENT
If a Buyer defaults:
— Buyer’s Premium is forfeited
— Auctioneer may:
— resell the Lot
— recover damages
— suspend or ban the account
14. PROHIBITED BIDDING CONDUCT
a. Excessive double bidding is prohibited
b. Auctioneer may:
— cancel bids
— suspend accounts
c. All bidders must act:
— in good faith
— without manipulation
15. PRIVACY & COMMUNICATION
By participating, bidders consent to being contacted by:
— Auctioneer
— Seller
— authorised representatives
For purposes including:
— identity verification
— negotiation
— settlement
16. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes rights under:
— Competition and Consumer Act 2010 (Cth)
However:
— goods sold at auction may not carry standard consumer guarantees
17. DESCRIPTIONS & UPDATES
a. Listings may be:
updated at any time prior to auction close
b. Buyers are responsible for:
— reviewing the latest listing details
18. GENERAL
a. All amounts are in AUD
b. These Terms are governed by:
Victoria, Australia law
